In Hongkong, the existing law on the subject is contained in S.4 Ord. 6 of 1894; at the Straits, there is a similar provision in S.17 of Ord. 17 of 1896, & in the latter Colony, Laws have been enacted enabling the Police to institute proceedings; but in all these Laws, the only proceeding that can be successful is in a case where the place is used "to the annoyance of the respectable inhabitants of the vicinity," and this restriction has, I am informed, been fatal to the success of such prosecutions.
In Colombo (where the law is somewhat similar), it is difficult to prove "annoyance."
I have drafted the despatch to meet this difficulty.
The draft despatch carries out Mr. Chamberlain's minute above, but before he passes the despatch, I hope Mr. Chamberlain will pardon my drawing his attention to Lord Lister's speech in the House of Lords last May (especially to the points referred to by Mr. Fawcett on p. 15 of his Speech - annexed hereto), which showed the impossibility, on medical grounds, of treating venereal disease in the same way as other contagious diseases (as regards notification & isolation).
